Mortgage Foreclosure - Archie F. Flowers
MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Archie F. Flowers, a single man, on February 12, 2002, to Conseco Finance Corp - Alabama, which mortgage is recorded in Official Record Book 59A, Page 848, in the Office of the Judge of Probate of Coffee County, Alabama, and assigned to U.S. Bank, N.A., as Trustee for Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate 2002-1, which Assignment is recorded in Official Record Book 140A, Page 84, in the Office of the Judge of Probate of Coffee County, Alabama the undersigned, as Mortgagee or Transferee, under and by virtue of the power of sale contained in the said mortgage will sell at public outcry to the highest bidder for cash in front of the main entrance of the Coffee County Courthouse in Elba, Alabama, on August 22, 2012, during the legal hours of sale the following real estate situated in Coffee County, Alabama, to wit:
A lot or parcel of land located in Coffee County, Alabama and being more particularly described as follows: Commencing at the southwest corner of Lot 10, J. O. English Subdivision as recorded in Miscellaneous Book 8, Page 578, Probate Office, Elba, Alabama; thence S 45 degrees 33 minutes 19 seconds E along the Northeasterly right of way of Coffee County Road #401 654.27 feet to the point of beginning; thence continue along the Northeasterly right of way of Coffee County Road #401 S 44 degrees 35 minutes 34 seconds E 216.87 feet to a point; thence N 45 degrees 24 minutes 26 seconds E 210.00 feet to a point; thence N 44 degrees 35 minutes 34 seconds W 216.87 feet to a point; thence S 45 24 minutes 26 seconds W 210.00 feet to the point of beginning. Said property being located in the SE ¼ of the NW ¼ and the NE ¼ of the SW ¼, Section 21, Township 5 North, Range 20 East and containing 1.045 acres more or less.
Together with the hereditaments and appurtenances thereunto belonging. Said property will be sold on an “AS IS, WHERE IS” basis subject to the right of way easements and restrictions of record in the Probate Office of Coffee County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to the subject property.
This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
