FORECLOSURE NOTICE

WHEREAS, on September 6, 2005, James D. Williams, a/k/a Daryl Williams did execute and deliver to Brantley Bank & Trust, a mortgage on certain real estate hereinafter described, which mortgage appears of record in the Office of the Judge of Probate of Coffee County, Alabama, at Mortgage Book 89A at page 294, and,
WHEREAS, default has been made in the payment of said Mortgage as provided herein, which default continues at this date and said Mortgage is subject to foreclosure.
NOW, THEREFORE, notice is hereby given that the undersigned will sell at public outcry for cash, to the highest bidder, in front of the Coffee County Courthouse, in Luverne, Crenshaw County, Alabama, during the legal hours of sale on August 28, 2012, the real estate being more particularly described as lying and being situated in Coffee County, State of Alabama, to-wit:
PARCEL 1:  A lot or parcel of land in the North half of the Northwest Quarter (N ½ of NW ¼) of Section 22, Township 7 North, Range 19 East containing 1 acre more or less; more specifically described as follows:  From the Southwest corner of the NW ¼ of NW ¼ Section 22, Township 7, Range 19, go South approximately 96 feet to the centerline of a paved road known as the 3-Notch Road; thence run easterly along the centerline of this road approximately 1144 feet to the point of beginning; thence continue along the centerline for 210 feet to the intersection of the centerline of the Glenwood-Elba paved road; thence in a southerly direction along the centerline of this road for 210 feet; thence in a westerly direction parallel to the 3-Notch Road for 210 feet; thence in a northerly direction parallel to the Glenwood-Elba Road for 210 feet to the point of beginning.
LESS AND EXCEPT, one-half interest in all oils and minerals located on said land during the lifetimes of Annie Laurie Brown or her Husband, Hal Brown (see deed recorded in Office of Judge of Probate, Coffee County, Deed Book 24A, Pages 505-507)
PARCEL 2:  A lot or parcel of land in the N ½ of NW ¼ of Section 22, Township 7 N, R 19 E located in Coffee County, Alabama described as follows:  From the SW corner of the NW ¼ of NW ¼ Section 22, T 7 N, R 19 E go South approximately 96 feet to the centerline of Three Notch Road; Thence run in a northeasterly direction along centerline of said road for a distance for 1354 feet to the intersection of the centerline of the Troy-Elba Highway; thence in a southeasterly direction along the centerline of the Troy-Elba Highway for 210 feet; thence run in a southwesterly direction 45 feet to the west side of the right-of-way of the Troy-Elba highway, the beginning point of lot; thence continue in a southwesterly direction and parallel to power line for 164 feet; thence run in a southeasterly direction and parallel to said highway for 133 feet; thence run under power line in a northeasterly direction 164 feet; thence run in a northwesterly direction along west side of right-of-way of said highway 133 feet to beginning point of lot.  Said lot contains one-half (1/2) acre more or less.  Less and Except all oil and mineral rights reserved to Charles Dixon and Thelma Dixon.
PARCEL 3:  Beginning at NW corner of Lot #1 run southeasterly, a distance of approximately 337 feet to the right of way of power line, thence run westerly approximately 1300 feet to a point and run northwesterly approximately 650 feet to South right-of-way of Three Notch road and then run Easterly 850 feet back to point of beginning, being in the NW ¼ of Section 22, Township 7, Range 19 east, located in Coffee County, containing 13 acres more or less, together with all improvement thereon.
To Include a 1989 Fleetwood Mobile Home, 14 x 56 bearing a vin #GAFLJ07A17375WF. 
Said sale and conveyance will also be made subject to the legal rights of existing Federal Tax Liens, and/or Special Assessments, if any, which might adversely affect title to the property.
Such sale will be made as provided in the mortgage for the purpose of paying the debt secured by the mortgage with interest thereon, any amounts required to be paid for taxes, insurance or other charges provided in said mortgage, and the expenses of foreclosure, including a reasonable attorney’s fee.
Said property will be sold on an “as is, where is” basis subject to any easements, encumbrances, and exceptions contained in said mortgages and those contained in the records of the Office of the Judge of Probate where the above-described property is situated.  The property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment, and will be sold subject to the right of redemption of all parties entitled hereto.
